Please read these terms and conditions carefully before placing your order and retain a copy of these terms and conditions and your order for future reference.

Definitions

In these terms and conditions:

We, us and our refer to BathroomTakeaway.com, owned and operated by BathroomTakeaway Limited (registered in England and Wales under company number 09285647 and with its registered address at Unit 16 Floats Rd, Roundthorn Industrial Estate, Wythenshawe, Manchester M23 9LJ)

you and your refer to the purchaser of any goods from us.

Contract means the contract between you and us for the sale by us to you of goods.

Goods means any goods or services you order from us.

Order means an order placed by you with us for the purchase of goods by clicking "place order" on the checkout page.

Consumer means any natural person who, when placing an order with us, is acting for purposes which are outside his or her trade, business or profession.

Checkout page means the page on our website entitled "checkout" which gives details of the goods, delivery address and options, payment method and a "place order" icon.

Website means our website at BathroomTakeaway.com

Business sales

If you order goods other than as a consumer (e.g. because you are a business) then:

These terms and conditions do not apply; and

our business terms and conditions shall apply to your order and any resulting contract between you and us.

Terms of contract

We may change these terms and conditions at any time. Any changes will apply to any orders that you place after the time that we update the terms and conditions on our website. The changes will not apply to any order that you place before we make the changes on our website.

We have taken care to ensure that our website (including the help pages) and these terms and conditions do not contradict each other. However, if there are any inconsistencies or contradictions then these terms and conditions shall apply instead of any contradictory or inconsistent part of our website.

When the contract is created

No contract exists between you and us until we notify you that we have accepted your order and delivered the goods.

We are not obliged to accept your order.

We may cancel your order if we cannot supply the goods for any reason.

Description and price of goods

We make every effort to ensure that prices and descriptions of goods shown on our website are accurate at the time you place your order.

The price of the goods will be as shown on the checkout page of our website when you placed your order. We will charge you this amount.

You must also pay a delivery charge for the goods as indicated on our website at the checkout page.

In the unlikely event that the price shown on the checkout page is wrong, and we discover this before accepting your order, we are not required to sell the goods to you at the price shown. We always try and ensure that the prices of goods shown on our website are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel your order and you have already paid for the goods, then you will receive a full refund. We may occasionally have to increase the price of goods, even after your order has been accepted by us. If we have to do this, then you may cancel your order.

Delivery

We will deliver the goods that you order to the delivery address you give when you place your order.Please note, Bathroom Takeaway Ltd do not deliver outside of the UK*. Addresses that are not mainland UK but are still within the United Kingdom may also be excluded or incur additional delivery charges. We advise customers contact us to enquire before placing any orders outside mainland UK.

Once we accept your order, we will endeavour to deliver the goods within the delivery period that applies to the option you have chosen. If we do not come to the delivery address within the applicable delivery period and you have given us the correct full delivery address then you may apply for a refund of the delivery charge.

If there is no one available to accept the delivery when our courier arrives, the courier will keep the goods for up to two days and you can arrange for a new delivery date. After two days we may treat the order as cancelled by you. In this case, we will refund the price of the goods, but we shall be entitled to keep the amount you paid for delivery.

If you give us an incorrect or incomplete delivery address and as a result, we try but are not able to make the delivery, we may treat the order as cancelled by you. In this case, we will refund the price of the goods, but we shall be entitled to keep the amount of money you paid for delivery.

If some of the goods you ordered are not available we may deliver part of your order. We will deliver the rest of the order as soon as possible afterwards.

We aim to dispatch all orders as soon as possible, in the majority of cases this is done the same day. Once your order has been packed and dispatched we will send you an e-mail confirming this, along with tracking details of the parcel(s). Please note that orders are only dispatched Monday to Friday, excluding Bank Holidays. Orders placed over the weekend or on a Bank Holiday will be dispatched the next working day. Please note we do not dispatch orders or delivery on a Saturday or Sunday.

We do operate using third party couriers where neccessary and cannot be held responsible for any unforeseen delays once items are dispatched and within the courier's network.

Whilst we aim to fulfil all orders within the estimated time, this is unfortunately never guaranteed.

We recommend that you do not book a fitter/plumber or complete any pre-installation works until you have received the product and are completely happy with it.

Orders of £399 or over will be delivered Free of charge on a standard delivery service to UK Mainland postcodes.

AB, BT, DD, FK, GY, HS, IM, IV, JE, KA, KW, PA20-78, PH, TR21-25, ZE

*If you are outside of the UK and would like to order from us, you may be able to arrange your own courier to collect from us however this is at the discretion of Bathroom Takeaway Ltd. Bathroom Takeaway Ltd will accept no liability for damage or loss when a delivery or return is arranged by the customer. Please contact us for further information.

Your right to cancel

You may cancel the contract under the Consumer Contracts Regulations by notifying us you wish to cancel the contract and ensuring the product is returned to us no later than 30 days after we deliver the goods.

You may not cancel your contract with us under the Consumer Contracts Regulations where any item has been specially ordered or manufactured for you.

If you cancel the contract under the Consumer Contracts Regulations, you must take reasonable care of the goods from the time you receive them until you return them to us.

If you cancel the contract under the Consumer Contracts Regulations you must return the goods to us at your own expense.

If you cancel the contract under the Consumer Contracts Regulations and do not return the goods as required, we may charge you our direct costs of recovering the goods.

Once you have been issued with a tracking number for your order we are no longer able to stop the order, and you will have to return the order to us inline with our terms & conditions.

Guarantees

We provide a guarantee that on delivery and for a period of up to 20 years from date of invoice, the products shall be free from material defects in design or materials.

Your 20 year guarantee does not include the provision of or the rectification of:

Normal maintenance services and the repair and replacement of consumable items such as toilet seats, accessories, wastes and traps, cistern fittings, batteries, fluorescent tubes, light bulbs, fuses, electrical connections, filters, shower hoses, shower kits, tap and shower cartridges and tap washers;

Damage to, caused by or within parts, fixtures or fittings that have not been manufactured or supplied by us; Adjustment of hinges, catches, stays and doors; Normal wear and tear to your Qualifying Product;

Damage caused by failure to operate or use the Qualifying Product in accordance with its user instructions;

Environmental conditions including UV damage, discolouration or pollution; Damage caused by the use of inappropriate or unsuitable cleaning materials;

Damage occurring as a result of any alteration, modification, re-installation, vandalism, accidental damage, misuse, neglect, commercial use, abnormal use or storage or caused by any foreign object;

Damage resulting from a failure or delay in arranging for an obvious defect (or any defect which should have been obvious to a reasonable person who has complied with all relevant owner manuals and this Extended Guarantee) to be reported under your Extended Guarantee or rectified;

Damage caused by repairs attempted or undertaken other than those carried out by us or a third party authorised by us;

Damage as a result of failure to carry our normal day to day maintenance or follow normal maintenance procedures including but not limited to the maintenance procedures specified in the installation instructions;

Damage occurring from the incorrect use or connection of the utilities (including electricity, gas or water) to your Qualifying Product;

Damage as a result of any accessory (not approved by Bathroom Takeaway) being fitted to your Qualifying Product; Damage as a result of relocation of your Qualifying Product from its original installation; Damage caused directly or indirectly by war, riot, revolution, act of god or any similar event or by vandalism, theft or attempted theft; or Damage arising from any accident or any act or omission by you.

Our guarantee is subject to the following:
1. You immediately give us notice of a defective product, providing details of the defects complained of;
2. We being satisfied that the product’s defect is as a result of faulty design, workmanship or materials and that none of the exceptions above apply;
3. You will return the defective product to us if we request you to do so;
4. You will provide us with proof of purchase - for example, a copy of our sales’ Invoice and date;
5. You purchased the defective product from us or one of our approved resellers or installers.

If a product is not as warranted under this section, we will, at our cost and at our option, make good the defective product by repairing it, replacing and redelivering the defective portion of the product to the original delivery address, or refunding you the original purchase price. If the exact model is no longer available, we will endeavour to provide the nearest equivalent from our then current range. Our maximum liability to you under the contract shall be twice the value of the goods that you ordered.

As a consumer, the guarantee is in addition to your legal rights in relation to Products that are faulty or not as described. We will however under no circumstances offer compensation, or associated costs towards removal, installation or fitting. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.

Faulty goods

In these terms and conditions, faulty goods means any goods we supply to you that do not conform to the contract. Faulty goods does not include any goods that are faulty due to fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with their intended use, failure to follow the manufacturer's or our instructions, or any alteration or repair carried out without the prior approval of us or the manufacturer.

As advised on your shipping email, please thoroughly check your order on receipt of delivery. Report any damages and problems as soon as possible, so that we may make a claim. Any issues must be reported within 5 days. Not reporting any issues within this time frame may mean our customer service team are unable to provide any further assistance should you believe your goods have been damaged prior to receiving them.

Our website gives details of how to notify us of any faulty goods and how to arrange for the problem to be resolved. We strongly recommend that you call our customer service team on 0333 305 8200.

If you return goods because you think they are faulty goods, we may charge you the cost of all transport and our actual costs and expenses in the event that the goods are not, in fact, faulty goods.

Returning goods

When you return goods to us for any reason (for example because you have cancelled the contract under the Consumer Contracts Regulations or because you think they are defective goods):

You must ensure that they are properly and securely packaged and labelled with our address;

You are always responsible for any damage in transit that is due to incorrect or inadequate packaging by you; and

You are responsible for any damage or loss in transit where you arrange the transport either for collection or return.

Special / Made to order items cannot be cancelled, amended or returned once the confirmation has been received from the manufacturer. This happens within 12 hours of the order being placed.

Customer Made Products -Made-To-Order (Bespoke) Products

Made-To-Order (Bespoke) products are specially produced for an individual demand and once acknowledged by Bathroom Takeaway cannot be cancelled, returned or refunded.

Made-To-Order (Bespoke) products include:

  • Any bespoke orders such as RAL Colours/Special Finish items, as well as any other painted-to-order products;
  • All Radiators & feet, steel and cast-iron products are made-to-order (bespoke);
  • Out-of-stock items will dispatch on a similar timescale once in stock.
  • Please note that when placing an order that includes a painted radiator along with other items, the entire order will be treated as a single consignment and will not be part-dispatched. This is due to the specialized handling and processing requirements associated with painted radiators.

    We understand that you may require other items in your order more urgently. In such cases, we strongly recommend placing a separate order for the painted radiator to avoid any delays in receiving the remaining items. By doing so, we can expedite the dispatch of products not subject to the same processing times as painted radiators, ensuring you receive them as quickly as possible.

    By placing an order that includes a painted radiator along with other items, you acknowledge and agree to these terms, understanding that the entire order will be dispatched once the painted radiator is ready for shipment. Should you prefer to receive other items sooner, please consider placing separate orders.

    We appreciate your understanding and are committed to providing the best possible service while ensuring the quality and care of all our products.

    Vouchers, Gift Cards and Promo Codes

    Vouchers/Gift cards/Promo codes may only be redeemed through the web

    A Voucher may only be used once by its Holder and may not be copied, reproduced, distributed or published either directly or indirectly in any form or stored in a data retrieval system without our prior written approval.

    Any discounts attached to Vouchers/Gift Cards or Promo codes apply to the price of the Products ordered only and not to delivery charges, which will be chargeable at normal rates.

    We reserve the right to exclude the use of voucher codes on specific products. Vouchers will not be applied in conjunction with any existing account credit.

    We reserve the right to withdraw or deactivate any for any reason at any time.

    Please note - Vouchers/Gift cards/Promo codes are not valid on branded products such as those from RAK, Triton, Showerwall, Imperio, Grohe, Forum or on already discounted products or Plumbing Parts

    Force Majure

    We shall not be liable for any failure to perform, or delay in performing, any of our obligations under the contract if and to the extent that the failure or delay is caused by circumstances beyond our control.

    Limitation of Liability

    We shall not be liable to you for any loss or damage:

    Where there is no breach of a legal duty owed to you by us or by our employees or agents;

    Where such loss or damage is not reasonably foreseeable to us when we accept your order; or

    to the extent that any increase in loss or damage results from breach by you of any term of the contract.

    Our maximum liability to you under the contract shall be twice the value of the goods that you ordered.

    Nothing in these terms and conditions excludes or limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation or for any other liability that we are not permitted by law to exclude or (as the case may be) limit.

    These terms and conditions do not affect your statutory rights.

    Images of goods on our website are for illustrative purposes only and may differ slightly from the actual goods.

    Law

    These terms and conditions and the contract are subject to English law.

    VAT Relief

    If you have a disability or a long-term illness you MAY qualify for VAT relief under HMRC Guidelines which means that you won’t be charged VAT. Please click here to find out more.

    Please note, you need to submit a VAT Relief Claim form before placing your order, otherwise, we won't be able to refund the VAT on your order.
